The music download service (hereinafter "Service") is a provision of Ankama Music (hereinafter "Ankama") accessible from the website www.ankama-shop.com.

ARTICLE 1 - INTRODUCTION

The conditions herein exclusively govern the online sale of the Service by Ankama on the website www.ankama-shop.com. These conditions apply to the exclusion of all other conditions; including those applicable to the sale of products other than music downloads.

You agree that the information you provide about yourself is genuine and accurate.

The conditions herein are without prejudice to applicable legal provisions, including those contained in the Consumer Code.

The Service is reserved for the use of private individuals and adults without legal difficulties and cannot be used for business purposes.

Ankama can make any changes it deems necessary to the Service. The Terms and Conditions of Sale will be those existing on the website on the date the order is confirmed. We invite you to return regularly to keep abreast of developments to the Service.

The information recorded by Ankama constitutes proof of all transactions made between Ankama and its customers, unless proven otherwise.

ARTICLE 2 - USER ACCOUNT

To place an order on the website, you must:

The account gives access to the Service and will be accessible through with a username and password.

You must immediately inform Ankama of any loss or unauthorised use of your account's username and password. Passwords and usernames are personal and you agree not to disclose them. As such, you are solely responsible for their use.

Any attempt to use the password or username of another client is strictly prohibited.

ARTICLE 3 - OFFER AND RIGHTS

You have two purchase options:

  • Buying individual tracks
  • Buying individual albums

Full payment grants you the right to read and transfer downloaded audio files, without limitations, but for private use only. This right is not to be transmitted to third parties without the prior consent of Ankama.

ARTICLE 4 - ORDERS

A history of transactions between the client and the Service is available at all times in the "Manage your account" section of the website. We encourage you to periodically review your account and to contact Customer Service with any questions or if problems arise. A phone number is available to that end (at the cost of a local or national call depending on the origin of the call) and is indicated in Article 10 of these Terms and Conditions.

The archive of orders and invoices is made on a reliable and durable media and can be produced as evidence.

Upon validation of your order and payment, a link directing you to the "Your Downloads" section of your account will be sent by mail.

The download link can only be activated three times.

ARTICLE 5 - COST

The prices of our products are indicated in Euros and are inclusive of all taxes. Communication costs associated with the use of the Service remain the responsibility of the user.

Ankama reserves the right to change the price or these Terms at any time but the products or services will be charged on the basis of the rates and conditions that were in force at the time of checkout. Ankama will not offer any warranties or give refunds in the event of a price drop or promotional offer.

ARTICLE 6 - PAYMENT

Payment for your purchases can be made:

  • By cheque (only in France)
  • By credit card: Visa, MasterCard
  • By bank transfer.

The card will be debited at the time of the order.

An email containing the download link will be sent upon receipt and validation of payment.

ARTICLE 7 - RIGHT TO CANCEL

Pursuant to Article L 121-20-2 of the French Consumer Code, purchases of tracks and albums are final. No exchange or refund can be made, nor right to cancel invoked.

ARTICLE 8 - FIT FOR PURPOSE

We will undertake to exchange any damaged files. Should your files be damaged, we kindly request that you make a report in detail to Customer Service as quickly as possible in accordance with the procedures laid down in Article 10 herein.

Ankama will exchange the damaged file or files provided that such damages are the responsibility of Ankama (see Article 12). Whatever the situation, the guarantees concerning compliance and hidden defects still apply in accordance with the laws in force.

ARTICLE 9 - EXCHANGE

The exchange of goods under the circumstances referred to in Article 8 will be made as soon as possible and not later than 30 days following the date on which the right has been exercised.

ARTICLE 11 - INTELLECTUAL PROPERTY

11.1 - All music files, texts, comments, illustrations, artworks and images reproduced on Ankama websites are protected worldwide by copyright, trademarks, patents and other intellectual property rights and laws. In this regard and in accordance with the Intellectual Property Code, you agree that you will access the contents of the Service solely for your personal, non-commercial use. Any full or partial reproduction or representation of Ankama websites or all or part of the elements found on Ankama websites for purposes other than their use in accordance with their intended purpose is strictly prohibited. Any sale, exchange, lending or transfer of files to a third party is strictly prohibited.

In regard to the music files made available under the Service, only Ankama has the right to distribute these files and they are protected by national regulations and international copyright.

The client has the right to use these files solely for their personal, non-commercial use. Any other use is strictly prohibited and may lead to civil and/or criminal prosecution.

Should the music files available through the Service include identification markings and/or technical control measures, usage restrictions or protection, you agree not to infringe these measures, restrictions or protection and/or to edit or delete them.

You agree not to attempt to circumvent or modify the software needed to use the Service and not to violate these conditions by hindering, changing or deleting any information relating to the management of the products' rights or encourage or assist others to carry out such acts.

11.2 - The names, trademarks and distinctive logos displayed on Ankama websites are protected under trademark law. The reproduction or representation of all or part of any of the aforementioned is strictly prohibited and shall be subject to the prior written permission of the owner of the trademark.

ARTICLE 12 - USAGE AGREEMENT- RESPONSABILITY

12.1 - Usage Agreement

You agree:

  • Not to use the Service for illegal purposes
  • Not to use the information, Services and content provided on Ankama sites for commercial use.

12.2 - Responsibility

Ankama cannot be held responsible for any technical problems beyond its control, such as communication issues due to the client's Internet Service Provider (slowness or interruption of service are always possible) or technical problems encountered by Ankama's server host.

For technical reasons, including maintenance or network outage, a momentary interruption to the Service is possible.

You acknowledge and accept the known constraints and limitations of the Internet, particularly regarding the transmission of information via data networks and data breaches.

The customer is solely responsible for their use of the Service, and cannot hold Ankama accountable for any claims and/or proceedings made against them.

ARTICLE 13 - APPLICABLE LAW - DISPUTES

This contract is subject to French law.

The language of this contract is English, being a translation of the original French.

In case of dispute the French courts will have jurisdiction.

ARTICLE 14 - PERSONAL INFORMATION

The information and data kept about you is necessary to manage your order and our commercial relationship. It can be sent to companies that contribute to that relationship such as those responsible for dealing with the Services and orders, their management, execution, treatment and payment. This information and data is kept for security purposes in order to meet legal and regulatory obligations and also to enable us to enhance and customise the Services we offer and the information we send you. We will keep your personal data for as long as is required for the purpose of the processing herein.

In accordance with the French freedom of information act of January 6th 1978, you are entitled to access, amend and contend any personal information held about you. Ankama have the right to refuse any manifestly unreasonable application or any application not accompanied by the correct documentation. You agree that the data is complete, accurate and up to date; otherwise Ankama may terminate your rights to all or part of the Service.

Depending on the choices you made when registering, it is likely that you will receive offers from our company and those of the Ankama group as shown when creating your account. If you no longer wish to receive these offers, you can notify us using the unsubscribe link.

You declare that you have read and accepted the Terms and Conditions of the order, including all information relating to the goods or services ordered, the price, the delivery time and the method of delivery before placing your order.
